Paytm Mall, Snapdeal Sentenced For Selling Pressure Cookers Guilty: 5 Points

The CCPA has ordered Paytm Mall and Snapdeal to recall the damaged pressure cookers.

The CCPA Consumer Protection Body has imposed a penalty of Rs 1 lakh each on e-commerce firms Paytm Mall and Snapdeal for selling “non-standard” pressure cookers. The Central Consumer Protection Authority (CCPA) has asked online retailers to withdraw goods sold and refund the amount paid by consumers. The CCPA found Paytm Ecommerce (Paytm Mall) and Snapdeal guilty of selling pressure cookers, which did not meet the Standards Bureau of India (BIS) and did not comply with the Domestic Pressure Cookers Quality Control (QCO) Order, 2020.

  1. Paytm Mall lists Pristine and Quba pressure cookers, which do not have the ISI mark; while Snapdeal lists Saransh Enterprises and AZ Sellers cooks on its platform that do not comply with the norm.

  2. The CCPA has instructed Paytm Mall and Snapdeal to recall the faulty pressure cooker and reimburse the amount to consumers, respectively. It has also asked e-commerce firms to submit similar compliance reports within 45 days.

  3. Both Paytm Mall and Snapdeal, in their case, argue that they are intermediaries under the Income Tax (IT) Act and the responsibility for the content lies with the seller and not on them.

  4. In response, the CCPA cites Eules Consumer Protection (E-Commerce), 2020 which states that no e-commerce entity may adopt any unfair trading practices either in the course of business or on its platform or otherwise. Under the Consumer Protection Act, goods that violate mandatory standards can be considered “defective”.

  5. Last week, the CCPA had ordered the cessation of several misleading advertisements of Sensodyne toothpaste within seven days and imposed a penalty of Rs 10 lakh on the manufacturer.
